Te Ao Maramatanga - New Zealand College of Mental Health Nurses has released a Practice Note to provide guidance to their members following certain amendments to the Mental Health (Compulsory Assessment and Treatment) Act (1992) that came into effect in January 2018. The changes included an expanded definition of who could complete the section 8B certificate which accompanies the section 8A application to trigger an assessment examination at section 10. Section 8B(1) provides for the section 8B certificate to be completed by a “health practitioner”, further defined in section 8B(6)(2) as a nurse practitioner, and in section 8B(6)(3) as “a registered nurse practising in mental health”. The amendment raises an issue about the assessment of a person’s mental capacity by nurses. To provide guidance on this matter the board has developed a Practice Note for nurses about completing certificates under section 8B. This is available here.
